1. Introduction and Guiding Principles

This policy applies to all content created, commissioned, or published by Atmostfear Entertainment across all platforms and media, whether now known or hereafter devised. It governs all employees, contractors, freelancers, and any third party seeking to use our content.

2.1. Foundational Principles

Copyright protection is granted automatically from the moment of a work’s creation and does not require formal registration to be legally protected. These rights include moral rights (like the right to attribution) and patrimonial rights (the exclusive economic rights to reproduce, distribute, and adapt the work).

2.2. Content Created by Employees

All content created by employees of Atmostfear Entertainment within the scope of their employment is considered a “work made for hire.” Atmostfear Entertainment is the sole author and owner of all copyrights in such content from the moment of its creation.

2.3. Content from Freelancers and Contributors

No content shall be commissioned or accepted from any non-employee without a signed, written agreement. This agreement must explicitly transfer all exclusive, perpetual, and worldwide patrimonial rights to Atmostfear Entertainment for use in all media and formats, whether now known or hereafter devised. This includes the specific right to use the contribution for data analysis and as part of datasets for machine learning or AI training, a measure designed to prevent future legal challenges based on new technologies.

3. Permitted and Prohibited Uses of Our Content

All content published by Atmostfear Entertainment is our exclusive property or is used under license. Any use not explicitly permitted below is strictly prohibited without a prior written license agreement.

3.1. Permitted Uses

  • Personal, Non-Commercial Use: You may view, download, or print extracts of our content for your own personal, non-commercial use only, provided you maintain all copyright notices.
  • Linking: You are welcome to share direct hyperlinks to our content, provided the link does not damage our reputation or suggest any form of association or endorsement where none exists.
  • Limited Quotation: The use of short excerpts of text for the purposes of commentary, criticism, or academic research may be permissible. Such use should be insubstantial and must always be accompanied by clear and prominent attribution to “Atmostfear Entertainment” as the source, with a hyperlink back to the original content where possible.

  • Use for Artificial Intelligence (AI) Training: Using any of our content, in whole or in part, for any machine learning or artificial intelligence-related purpose, including the training of any AI system, algorithm, or model, is strictly prohibited. This activity is considered an unauthorized reproduction that directly harms the market for our original work.

4. Licensing Our Content

For any use not explicitly permitted by this policy, a license is required. All inquiries regarding licenses to use our content must be directed to our legal department at legal@atmostfear-entertainment.com. We offer a range of licensing models for commercial and corporate use.

5. Using Third-Party Content

All our employees and contributors are legally and ethically bound to respect the copyrights of third parties.

  • Fair Use: The limited use of third-party copyrighted material for purposes such as criticism, news reporting, or research may be permissible under doctrines like “fair use.” However, this is a limited defense, not an automatic right. Any reliance on fair use must be a considered decision, and our default position is to license third-party content whenever possible.
  • Attribution: Proper attribution to the author and/or copyright holder of any third-party content is a mandatory principle of our Editorial and Ethical Standards.

We respect the intellectual property of others and have a formal procedure for addressing infringement claims.

6.1. Reporting an Infringement
