1. Introduction and General Principles

At Atmostfear Entertainment S.A.S. (“we,” “us,” “our”), we are committed to transparency and fairness in all our commercial transactions. This Refund Policy outlines the terms and conditions under which refunds are processed for our various products and services.

This policy is an integral part of our Terms of Service. By making a purchase on our website, you acknowledge that you have read, understood, and agree to the terms of this Refund Policy. Our policies are designed to be fully compliant with the Colombian Consumer Statute (Law 1480 of 2011).

2. Digital Products (Aegis Pro Plugin)

Due to the nature of digital goods, which are irrevocable once delivered, our policy on refunds is strict.

  • Refunds for Defective Products: We will issue a refund for our Aegis Pro plugin only if the product is defective or non-functional due to an issue originating from our code. To be eligible for a refund under this condition, you must contact our support helpdesk within five (5) business days of your purchase and provide evidence of the defect.
  • No Refunds for Other Reasons: We do not provide refunds for digital product purchases for reasons including, but not limited to, changing your mind, dissatisfaction with the product, or conflicts with third-party software. It is your responsibility to review the product’s features and requirements before making a purchase.
  • Right of Withdrawal Exception: In accordance with Colombian law, the “Right of Withdrawal” (Derecho de Retracto) does not apply to contracts for the supply of digital content once the download or use has begun. All sales of the Aegis Pro plugin are considered final once the product has been delivered to you.

3. Physical Products

  • Right of Withdrawal: For all physical products sold through our e-commerce platform, you have the right to exercise your “Right of Withdrawal” (Derecho de Retracto) as detailed in our Terms of Service. This right allows you to return the product for a full refund within five (5) business days of receiving it.
  • Final Sale: After the five (5) business day period for the Right of Withdrawal has expired, all sales of physical products are considered final and are non-refundable. This does not affect your rights under the “Legal Guarantee” (Garantía Legal) for products that are defective, which is also outlined in our Terms of Service.

4. Digital Services (Subscriptions & Hosting)

Payments for all our recurring digital services, including content subscriptions and hosting plans, are non-refundable.

  • No Partial Refunds: We do not issue refunds or credits for partial subscription periods, unused time on hosting plans, or for any reason once a payment has been processed. This applies to all billing cycles, including monthly and prepaid annual plans.
  • Cancellation: As stated in our Terms of Service, you may cancel your subscription or hosting plan at any time, but the cancellation will only take effect at the end of your current billing period. You will not receive a refund for the period between your cancellation date and the end of the billing cycle.

5. Custom Development and Creative Agency Services

Due to the significant investment of time and resources in our project-based creative and development services, our refund policy for these engagements is as follows:

  • Governed by SOW: All refunds, cancellations, and payment terms for agency services are governed by the specific Statement of Work (SOW) or contract signed for each individual project.
  • Non-Refundable Payments: Initial deposits, down payments, and payments for completed project milestones are non-refundable. These payments are used to cover the resources and labor already expended on the project and to secure your place in our production schedule.

6. How to Request a Refund

For the limited circumstances where a refund may be applicable (specifically, a defective Aegis Pro plugin), you must submit a request through our official support helpdesk. Your request must include your proof of purchase and a detailed description of the defect. Our team will review the request and determine eligibility based on the terms of this policy.

We reserve the right to modify this Refund Policy at any time. Any changes will be posted on this page, and we encourage you to review it periodically.
